Disclaimer
What we do — and do not — promise.
This Disclaimer forms part of our Terms of Service. Read it together with the warranty disclaimer in section 15 and the limitation of liability in section 16 of those Terms.
1. No warranty
The Service is provided “AS IS” and “AS AVAILABLE”. To the maximum extent permitted by law, we disclaim all warranties, express, implied or statutory — including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranty arising from course of dealing or trade usage.
We do not warrant that the Service will be uninterrupted, timely, secure or error-free, that defects will be corrected, that it will meet your requirements, or that data will be preserved without loss.
2. No guarantee of results
Publishing a website is not a business plan, and we do not sell one. We make no representation or guarantee as to:
- traffic, page views, visitors or audience growth;
- search engine rankings, indexing or visibility;
- advertising revenue, subscription revenue, conversions or sales;
- social media reach or engagement; or
- any commercial or professional outcome from using the Service.
Search engines, advertising networks and social platforms are independent third parties. They change their algorithms, policies and eligibility criteria without notice and without consulting us. Features that assist with search optimisation, metadata, or advertising integration are tools, not outcomes. Results depend overwhelmingly on your content, your market and your effort.
3. Content on customer sites
Sites built on Postlyo are created and controlled by our customers.
- We do not create, select, review, endorse or verify that content.
- Opinions expressed on a customer’s site are the site operator’s or the author’s, not ours.
- We are not responsible for the accuracy, legality, reliability or quality of content published by customers, or content submitted by their visitors.
- The presence of a site on our platform is not an endorsement of it, its operator, or anything it says or sells.
If you are a visitor with a concern about content, contact that site’s operator. To report unlawful content to us, see our Acceptable Use Policy.
4. Not professional advice
Nothing in the Service, our documentation, our marketing materials, or any template or sample content we provide constitutes legal, financial, tax, medical, accounting or other professional advice.
This applies especially to the legal page templates
The generated privacy policy, terms, disclaimer, cookie policy, DMCA policy and similar pages are generic starting points. They are not drafted for your business, your jurisdiction, your data practices or your risk profile. They have not been reviewed by a lawyer on your behalf. They may be incomplete or inaccurate for your situation, and may become outdated as the law changes.
You must review, adapt and verify them, and you should have them reviewed by qualified counsel before relying on them. Publishing a policy that misdescribes what your site actually does is worse than publishing none — it converts a gap into a misrepresentation.
Postlyo accepts no liability arising from your use of these templates. Providing them does not make us your lawyer, and no attorney-client or equivalent professional relationship arises from your use of the Service.
Consult a qualified professional in the relevant field and jurisdiction before acting on anything you find in or through the Service.
5. Third-party services and links
- We do not control third-party services and are not responsible for their content, availability, accuracy, security, practices or policies.
- Integration or a link is not an endorsement.
- Your use of a third-party service is governed by that party's terms and privacy policy, which you should read.
- We are not liable for loss arising from a third party's acts, omissions, outage, change of terms, or discontinuation of service.
See Sub-processors.
6. Availability and data loss
We aim for high availability but cannot guarantee uninterrupted service. Interruptions may arise from maintenance, faults, third-party failures, network conditions, or events beyond our control.
Maintain your own backups. Our backups exist for our disaster recovery, are retained for a limited period, and are not a per-item restore service. See our Data Retention Policy.
7. Accuracy of our own materials
We take care with our website, documentation and marketing materials, but do not warrant that they are complete, accurate or current. Features described may change. Screenshots and examples are illustrative. Pricing and plan details are those shown at the point of purchase.
8. External statements
Statements about Postlyo made by third parties — reviews, comparisons, tutorials, or claims by resellers or affiliates — are not ours and do not bind us. Only representations in these published documents, or made in writing by an authorised representative, do.
9. Jurisdictional limits
Some jurisdictions do not allow the exclusion of implied warranties or the limitation of certain damages. In those jurisdictions some or all of the above may not apply to you, and you may have additional rights.
Nothing here excludes or limits liability that cannot lawfully be excluded — including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or any non-waivable statutory consumer right.
